West Virginia Legalizes Aerial Fireworks"},"content":{"rendered":"<p>West Virginia used to be, like many states, a place where snakes and sparklers were about all the fireworks you could buy.<\/p>\n<p>Earlier this year, however, the state&#8217;s House of Delegates voted 96-0 to approve the sale and use of consumer fireworks beginning June 1 of this year. A month later, the Gov. Earl Ray Tomblin signed the bill into law. You can read <a href=\"http:\/\/www.legis.state.wv.us\/Bill_Status\/bills_text.cfm?billdoc=HB2852%20SUB%20ENR.htm&amp;yr=2016&amp;sesstype=RS&amp;i=2852\" target=\"_blank\" rel=\"nofollow noopener\">the full text of HB 2852 here<\/a>.<\/p>\n<p>The bill has implications for \u00a0retailers as well as consumers.<\/p>\n<p><a href=\"http:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks.jpg\" rel=\"attachment wp-att-777\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-777\" src=\"http:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks_crop2-856x1024.jpg\" alt=\"West Virginia Fireworks Celebration\" width=\"605\" height=\"724\" srcset=\"https:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks_crop2-856x1024.jpg 856w, https:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks_crop2-251x300.jpg 251w, https:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks_crop2-768x919.jpg 768w, https:\/\/www.superiorfireworks.com\/blog\/wp-content\/uploads\/2016\/04\/WVFireworks_crop2.jpg 1575w\" sizes=\"auto, (max-width: 605px) 100vw, 605px\" \/><\/a><\/p>\n<h2>What the West Virginia Fireworks Bill Means for Retailers<\/h2>\n<p>The bill has straightforward rules for those who want to sell aerial fireworks at \u00a0temporary stands or permanent retail locations.<\/p>\n<h3>Novelties<\/h3>\n<p>To register with the State Fire Marshal for novelty sales, you&#8217;ll have to:<\/p>\n<ul>\n<li>Submit an application<\/li>\n<li>Show proof of business registration<\/li>\n<li>Pay a\u00a0$15 fee<\/li>\n<li>Post your registration certificate in a visible location in your retail space.<\/li>\n<\/ul>\n<p>You need a separate registration for each retail location you run.<\/p>\n<h3>Aerial\u00a0Fireworks<\/h3>\n<p>In order to sell aerial fireworks, you&#8217;ll need to get a permit.\u00a0That means you have\u00a0to:<\/p>\n<ul>\n<li>Submit an application to the State Fire Marshal<\/li>\n<li>Show current business registration<\/li>\n<li>Pay $500 for a temporary retail stand or\u00a0$1000 for a permanent retail location<\/li>\n<li>Show proof a public\/product liability insurance with at least $1 million of coverage.<\/li>\n<li>Post the certificate in a visible place in your retail space<\/li>\n<\/ul>\n<p>Like in the novelties category we mentioned above, you have to get a separate permit for every location your run. The permit is good from April 1 to March 31.<\/p>\n<h3>The 12% Tax<\/h3>\n<p>&#8220;Tax&#8221; isn&#8217;t necessarily a welcomed word in the fireworks retail world (or any retail world, for that matter). However, lawmakers ensured taxes on West Virginia fireworks sales will go to a good cause.<\/p>\n<p>According to the bill, 75% of the tax will\u00a0support veterans&#8217; programs within the state. The remaining 25% will go into the state&#8217;s Fire Protection Fund, which helps support volunteer fire companies.<\/p>\n<h2>What the West Virginia Fireworks Bill Means for the Consumer<\/h2>\n<p>The \u00a0good news here is that residents in West Virginia can buy fireworks that go beyond sparklers and other novelties. However, keep in mind that the bill has some caveats.<\/p>\n<p>Consumers can buy these fireworks, but you aren&#8217;t allowed to ignite\/discharge\/use them if you are:<\/p>\n<ul>\n<li>On\u00a0public or private property without the permission of property owner.<\/li>\n<li>Launching said fireworks from a car or building.<\/li>\n<li>Launching said fireworks at a moving car or a building.<\/li>\n<li>Under the influence of alcohol,\u00a0controlled substances or drugs.<\/li>\n<\/ul>\n<p>Also, you aren&#8217;t allowed to buy or sell fireworks if you are under 18 years old.<\/p>\n<h2>More Changes to Fireworks Laws in Other States?<\/h2>\n<p>Posters on the popular fireworks website <a href=\"http:\/\/www.pyrotalk.com\" target=\"_blank\" rel=\"nofollow noopener\">PyroTalk.com<\/a> have pointed out that both Pennsylvania and Arizona have proposed bills to expand fireworks laws.<\/p>\n<p>We&#8217;ll keep you posted on what&#8217;s happening in those states, as well as any other states making changes to their fireworks laws.
