Texas Independence Day

New Texas Fireworks Laws for 2016

State lawmakers decided there needs to be more room in the calendar for Texas fireworks.

New for 2016, state residents can buy fireworks on Texas Independence Day (March 2), San Jacinto Day (April 21) and Memorial Day (May 30), in addition to New Year’s Day and July 4.

The Fine Print About the New Texas Fireworks Laws

The expansion of the fireworks calendar comes with a couple of caveats, though:

  • Each county has final say on whether to adopt these additional sales dates.
  • The law doesn’t affect cities that have year-round fireworks bans.

When You Can Buy Fireworks for the New Dates

Texas’ fireworks laws also specify when fireworks will be sold for these three new holidays:

  • Texas Independence Day – February 25 – March 2
  • San Jacinto Day – April 16 – April 21
  • Memorial Day – The Wednesday before the last Monday in May, ending at midnight on the last Monday.

Important note: Along with the new regulations, lawmakers axed Texas’ 2% fireworks tax.

      The minimum age to purchase fireworks in the state of Texas is 16.

    What if the deed restrictions of one’s HOA strictly prohibit discharge, yet county does not.

      You are certainly subject to the restrictions of your HOA and we would recommend working with your neighbors to change this rule. Shooting fireworks wouldn’t be illegal as far as we know, but your HOA probably has fines or other enforcement methods that would apply if the rules are violated.

    Where can I go to find out if Harris county has adopted the three new fireworks holidays for texas

      We didn’t find any information readily available on the county website about this, but the fire marshal’s office should be able to give you the information you need: http://www.hcfmo.net/. If you’re interested in selling during one of those additional holidays, definitely let the county know.

      That shouldn’t be any problem at all. The state’s fireworks law only specifies dates when fireworks can be sold, not when they can be used. Have fun!

      In an unincorporated area, you would only be subject to the law of your county and the state. We aren’t aware of any county-level rules that are more restrictive than the state’s fireworks law, so you should be fine. We would encourage you to double check with your county to be sure.

      AJ, you can read a summary of the Texas fireworks law on the American Pyrotechnic Association website: http://www.americanpyro.com/assets/docs/State_Laws/tx13.pdf. Within Dallas city limits, though, we don’t believe you’re allowed to shoot fireworks. However, we would advise checking with your local authorities for specific guidance.

      Anna, we wouldn’t be able to provide a small quantity like you’re describing, unfortunately. Currently, we can only ship fireworks in wholesale quantities, which means buying by the case with a $1,000 minimum order. Also, we can’t provide specific guidance on this, but would advise researching the rules for transporting fireworks internationally before attempting to take anything into Mexico.

    A Fireworks Stand Owner posted that is against the law to set off fireworks in a city’s limits in Texas, is this true? I thought it was a local ordinance, not a State Law.

      The state law doesn’t mention this, but your city ordinances might. There are a lot of cities that seem to have these types of rules in place, even prohibiting the sale and use of fireworks within a certain distance of the city limits. It would be best to check with both your city and county governments to see what they allow.

      To our knowledge, the state law does not restrict when fireworks can be used. It only limits when they can be sold. However, local cities and counties sometimes have ordinances that are more restrictive, so it’s best to check with them before your event. I hope you have a fun weekend with your fireworks!

      Absolutely! Texas state law only limits when fireworks can be sold, not when they can be used. Of course, we always advise checking with your local government to be sure that they don’t have any additional restrictions.

        It depends on who is running the stand. Large companies with many retail locations might import from China and store everything in their own warehouses until the selling season. Others buy from a wholesaler like us. We handle all of the product sourcing, importing, storage, transportation, and all of the related regulatory and compliance requirements.     So I was told by a local firework seller (Red River County tx) that you are allowed to shoot off fireworks any day of the year now as long as there is not a burn ban in place. Is this true? We are doing some floating lanterns and fireworks at our wedding and it would be FANTASTIC if I dont have to wear my hot and heavy dress in July.

      That’s our understanding of the law as well. The only statewide restrictions are on when they can be sold, not when they can be used. I hope this helps!

    I live in El Paso Texas they sell fireworks every where dollar general wal-mart and Costco….my question is assuming they’re selling everywhere…can I pop them in my back yard?

      Andrea, the Texas state law says you cannot “explode or ignite fireworks within 600 feet of any church, a hospital other than a veterinary hospital, an asylum, a licensed child care center, or a public or private primary or secondary school or institution of higher education unless the person receives authorization in writing from that organization.” Other than that, it’s up to your local county or city government if they want to add additional restrictions. However, we cannot provide legal advice, and encourage you to double check with your local government to be sure of what’s allowed in your area. Happy Fourth of July!

    Where can you shoot your own fireworks? I live in Mansfield don’t want to drive too far, any place close? We moved here from Wisconsin where you can shoot right outside your front door.

      Brandon, from what we’ve read in the state law, it doesn’t seem like that would be an issue. However, we would always advise making sure your local government doesn’t have any additional rules that are more restrictive than the state law.

      As a disclaimer, we can’t offer specific legal advice. That said, if there’s no pyrotechnic compound in the item, then we don’t see how the fireworks law would apply. Things like model rockets are already exempt from the law, so it would probably depend on your exact product and usage.
